Embezzlement
Embezzlement under Michigan criminal law occurs when a person, usually in a position of trust and responsibility, commits a theft of a companies assets, which may include money or property. The crime of embezzlement is broader than stolen money, it applies to any theft of property. Michigan law defines embezzlement as the crime of stealing all or small parts of property when they have been entrusted with monitoring or managing property. An individual with authorized access to another's property who takes advantage of that access for personal gain.
Typically embezzlement involves the repeated taking of small or large amounts over time, prosecutors often charge a person with multiple counts. Each count will result in prison time, which may have to be served consecutively. You should obtain legal representation as soon as possible.
Employee Embezzlement charges in Michigan may be either a misdemeanor or a felony, depending upon the amount of money or property which was involved. If convicted of an embezzlement crime in Michigan, the consequences may involve hefty fines and even a possible prison sentence. To prove you guilty of larceny by embezzlement in Michigan the prosecution must prove three things to a judge or a jury beyond a reasonable doubt.
1- That while in a position of trust of confidence you were entrusted with possession of personal property belonging to someone else;
2- That you took that property, or that you hid that property or that you somehow converted it to your own use without the owner's consent to do so;
3- That you did so with the intention of permanently depriving the owner of his property.
This case often arises in the context of an employer-employee relationship. However, this crime can occur in other fiduciary relationships, where one party has access to another party’s assets, money or business interests. The Michigan prosecutors will look for evidence of altered records, or other White Collar Crimes that were committed to hid the Embezzlement.
